1. Service Description

ImportIntel Australia Pty Ltd (“ImportIntel”, “we”, “us”) operates an AI-powered import intelligence platform at globalimportintel.com (the “Service”). The Service provides AI-generated analysis reports covering HS code classification, duty estimates, biosecurity considerations, freight routing, and landed cost modelling for goods being imported into Australia.

2. Account Terms

• You must be at least 18 years of age and have legal capacity to enter into contracts to create an account.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must provide accurate and complete information when registering and keep your account information current.
• You may only create one account per person or business entity unless explicitly authorised by ImportIntel.
• You must verify your email address before accessing paid features.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation, including Australian customs and import laws.
• Submit false, misleading, or fraudulent shipment information.
• Attempt to reverse-engineer, copy, or redistribute any part of the platform.
• Use automated tools (bots, scrapers) to access the Service without prior written consent from ImportIntel.
• Transmit malware, viruses, or any harmful code.
• Interfere with or disrupt the integrity or performance of the Service.
• Share your account credentials with unauthorised third parties.

4. Payment Terms

• All prices are displayed in Australian Dollars (AUD) and are exclusive of GST unless otherwise stated. GST will be added at checkout where applicable.
• Subscriptions are billed monthly or annually in advance depending on the plan selected.
• Annual subscriptions receive a 20% discount compared to monthly billing and are charged as a single upfront payment.
• You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period; no partial refunds are provided for unused periods.
• We reserve the right to change pricing with 30 days notice to existing subscribers. Continued use after the notice period constitutes acceptance of the new pricing.
• Failed payments may result in service suspension until outstanding amounts are resolved.

5. Intellectual Property

All content, software, design, and AI models that make up the ImportIntel platform are the intellectual property of ImportIntel Australia Pty Ltd or its licensors. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for your internal business purposes only. You may not reproduce, redistribute, or create derivative works from any part of the Service without our prior written consent.

Reports generated by the Service may be used internally or shared with your clients in connection with legitimate import activities. Reports may not be resold as a standalone product without a Forwarder plan or a separate white-label agreement.

6. Limitation of Liability

To the fullest extent permitted by Australian law, ImportIntel and its officers, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service, including but not limited to: customs penalties, biosecurity fines, freight losses, delayed shipments, or financial losses arising from reliance on AI-generated analysis.

Our total aggregate liability to you for any claim arising from these Terms or your use of the Service shall not exceed the total subscription fees you have paid to ImportIntel in the 12-month period preceding the claim.

Nothing in these Terms limits liability that cannot be excluded under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010), including liability for death or personal injury caused by negligence.

7. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated analysis will be accurate, complete, or current. Tariff schedules, duty rates, and regulatory requirements change frequently; always verify critical information with a licensed customs broker or the Australian Border Force.

8. Termination

You may terminate your account at any time by contacting us or using the account deletion feature in your account settings. ImportIntel may suspend or terminate your access immediately, without notice, if you breach these Terms or if continued access poses a legal or security risk. Upon termination, your right to use the Service ceases immediately and we may delete your data in accordance with our Privacy Policy.

9. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

11. Changes to These Terms

We may update these Terms of Service from time to time. When we do, we will update the “Last updated” date above. Material changes will be communicated to registered users by email at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
